Contract Disputes

  • Is My Insurance Policy a Contract?

The answer is yes. An insurance policy is a contract that you have with the insurance company. When the insurance company fails to pay you or underpays you for your claim, in most cases that is considered a breach of contract

  • Should I handle the claims process by myself?

Absolutely not! Most insurance companies have teams set up to convince you to take the least amount possible and agreeing to take that amount in writing, releasing your ability to fight them for more money after you realize the company has undervalued your loss or injury. This applies to your own insurance company or a third party carrier in personal injury matters.

  • Why Hire a Contracts Attorney?

A contracts attorney has the expertise to breakdown complicated contractual language and navigate policy exclusion, special provisions or complicated contractual terms.

Personal Injury

  • HOW DOES A PERSONAL INJURY CASE WORK?

Once you have completed your medical treatment, we will send a demand letter to the insurance company at fault, which will include all of your medical records and bills. Once the insurance company receives the demand, they have about 30 days to respond to our offer to settle with a counter offer or acceptance. We will then contact you to discuss the offer presented and what the next step would be in our negotiation process.

  • WHAT IF IT TAKES TOO LONG FOR THE INSURANCE COMPANY TO COMPLETE THEIR LIABILITY INVESTIGATION?

If you do not want to wait for the at fault insurance company to complete its investigation, you can use your collision coverage on your own auto insurance policy, if you have it.

  • HOW LONG WILL MY CASE TAKE TO FINALIZE?

Every case is different. However, most cases take approximately 6 months to a year. If we have to file suit, it may take longer.
